6.1. OUTLOT 22 AND OUTLOT 23 IN SECTION 34-155-82W

It is recommended that the City Council approve a request by Bradley Weber, Owner, to subdivide unplatted portions of the SE1/4NE1/4SE1/4 of Section 34-155-82W to create outlot plats for proposed Outlots 22 and 23.  

6.2. PUBLIC HEARING: MCHENRY ADDITION, LOT 1

  1. A public hearing to consider a request by FMI, Inc. to pass an ordinance to rezone a portion of Outlot 7 in Section 14-155-83 from R3B (Multiple Residential Medium Density) to C2 (General Commercial District).  
  2. It is recommended the City Council approve a request by FMI, Inc., to subdivide Lot 1, Boyce’s Addition, together with a portion of Outlot 7 in Section 14-155-83 to create McHenry Addition, Lot 1.

6.3. LAVIOLETTE ADDITION, LOTS 1 & 3- CUP OUTDOOR STORAGE

It is recommended the City Council adopt a resolution for a Conditional Use Permit (CUP) for indoor self-service storage and outdoor storage of RVs, boats, automobiles, and related recreational vehicles/items on property zoned M1 (Light Industrial District) located at 3100 County Road 19S.

6.4. PUBLIC HEARING: EASTSIDE ESTATES, LOT 7, BLOCK 2

A public hearing to consider a request by Eugene Kraft to pass an ordinance for a zone change from R1 (Single-Family Residential District) to MH (Manufactured Home District) to locate a manufactured home on property located at 3465 47th Street, SE. The Planning Commission recommends that the City Council deny the application.

7.5. 2018 STORM SEWER REHAB – FINAL PAYMENT (PROJECT NUMBER 4314)

Each year, funds are allocated in the storm sewer budget to repair or replace storm sewers around town. The improvements generally consist of repairing catch basins and replacing or extending pipes to improve storm water conveyance.  In 2018, the project consisted of removing and replacing a section of storm sewer in the vicinity of 13th Street and 5th Ave NW.  A section of watermain was also replaced along the same corridor.  The project was bid in March of 2018 and the low bidder was Wesslen Construction at $258,107.98.  Wesslen Construction has completed all items remaining for the project.

Recommend approval of the final payment in the amount of $2,580.80 to be paid to Wesslen Construction, Inc.

7.6. CITY COUNCIL APPROVE 2019 ROUND 4 DEMOLITION/SITE RESTORE CONTRACT

The City issued bids for a fourth round of CDBG-NDR acquired structures for demolition and site restoration in support of the flood control projects. The City received three bids all of which were determined to be responsible although all three contained minor technical errors which were found to be not substantial per HUD guidance since none related to the actual bid prices.  

It is recommended the City Council award Round 4 Demolition bid to the lowest responsible bidder which is Hight Construction, LLC at $342,675.

On September 19, 2019 the Public Works Department opened bids for washed sand for the upcoming snow removal season. Four bids were received, and they are as follows:

On September 19, 2019 the Public Works Department opened bids for road deicing salt for the upcoming snow removal season.  Three bids were received and they are as follows:

On September 24, 2019 the Public Works Department opened bids for chemicals at the Minot Water Treatment Plant for 2020.  Results of the bid opening are tabulated below:

Per the agreement when water and wastewater chemicals were bid in 2018, Lhoist North America exercised the option to extend for an additional year with a 2.9% increase.  Lhoist will provide quicklime for 2020 at a rate of $142/ton.

Recommend award of bid to the following suppliers for water and wastewater treatment chemicals as follows:

  • Carbon dioxide awarded to American Welding and Gas for $240.00/ton
  • Chlorine awarded to Hawkins for $625.00/ton
  • Ammonium Sulfate to Hawkins for $0.306/lb
  • Calcium Nitrate awarded to Hawkins for $2.82/gallon

7.11. STATION #2 GENERATOR REPLACEMENT (PROJECT NUMBER 4463)

On September 10, 2019, bids were opened for the replacement of a back-up generator at Fire Station #2. Three bids were received, and they are as follows:

7.12. APPROVE ADDING 3 SPOT BLIGHT PROPERTIES FOR AUCTION

HUD rules allow the City once properties are acquired and restored with green grass to sell them but any such disposition requires meeting a different National Objective which means Urgent Need and/or LMI beneficiary.  Local ordinance and North Dakota Century Code require that property to be sold to private interests must be sold via auction when the value is above a certain amount which in the case of Minot is $5,000.  The City Council has approved use of Urgent Need and LMI National Objectives for sale at auction.

It is recommended the City Council approve adding 326 7th St. NW, 215 6th St. NW, and 301 7th St. NW to the list of City acquired Spot Blight properties for Auction sale under approved rules.

7.13. AUCTION OF FLOOD BUYOUT ACQUIRED STRUCTURES

As the City acquires properties for the flood mitigation projects, it has periodically presented to the City Council approval requests to auction structures on such property deemed sound and able to be moved. A new aggressive set of policies and procedures has been implemented to make more effective and timely determinations on acquired properties with structures as to whether such structures should be demolished or auctioned. 

It is recommended the City Council authorize auction of property structures at 314 8th Street NE and 1030 6th Avenue SW acquired through the Involuntary Acquisition program for flood control projects.Documents:

8. ACTION ITEMS

8.1. CENTRAL RAMP LEASE AGREEEMENT

The DBPA has utilized space to store promotional material in storage at the parking ramps. This lease specifies the terms of the agreement as well as payment for the lease.

It is recommended the City Council grant approval of a lease agreement with the Downtown Business and Professional Association for lease of storage space in the Central Parking Ramp.

8.2. LEASE RENEWAL – LAVERNE MIKKELSON

The attached memo outlines the history of property owned/rented by the Mikkelsons. After reviewing the history of cropland damages and the cash rent paid by the Mikkelsons, staff recommends extension of the amendment to the cash farm lease for another 5 year period. Staff will also hire a firm to conduct a study during this period to try assess what amount of leakage may be attributed to the lagoon wetlands. Funds have been budgeted in the 2019 and 2020 budget for this type of study.

Recommend approval of the land rent extension with Laverne Mikkelson and authorize the Mayor to sign the agreement on behalf of the City.

8.3. GATHERING SPACE PROJECT

The deadline set by the City Council of September 30, 2019 to reach purchase price agreement with all Site # 2 property owners expired with no such agreements with all property owners. The Gathering Space Technical Review Committee met on October 1, 2019. The Committee has served to review and make recommendations to the City Council on key matters affecting such project. The Committee deliberated on all the options exploring likelihood of feasibility, timelines, scope of work involved and related matters.  

It is the recommendation of the Gathering Space Technical Review Committee that the City Council commence the acquisition process for Site #1 to locate the Gathering Space.

At the City Council meeting on September 16, 2019, a proposal by Alderman Wolsky regarding alternatives for the Gathering Space was tabled until after the September 30, 2019 deadline. Since the deadline has past, the discussion may continue. The memo is attached for review.
